Welcome to Builder Boost. These Terms of Use (“Terms”) govern your access to and use of the Builder Boost website, programs, events, forms, content, directories, services, and related offerings (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

Builder Boost is intended for real estate agents, builders, industry professionals, vendors, sponsors, and related business users. By using the Platform, you represent that you are at least 18 years old, have authority to enter these Terms, and are using the Platform for lawful purposes.

2. Your Account

You agree to provide accurate information, maintain account security, and notify Builder Boost of unauthorized access. You are responsible for activity occurring under your account.

3. What Builder Boost Provides

Builder Boost is a marketing, networking, educational, media, and community platform. Services may include directories, events, webinars, missions, media services, builder spotlights, buyer need boards, educational resources, and future offerings. Features may be added, modified, or removed at any time.

4. Acceptable Use

You may not scrape, harvest, copy, export, automate collection of data, impersonate others, misrepresent affiliations, create competing databases, train AI systems on Platform data, interfere with Platform operations, or use Platform information for unauthorized marketing.

5. Community Data Protection

Builder Boost has invested substantial resources in building its community, relationships, directories, builder information, event participation records, engagement history, and related compilations (“Community Data”). Community Data is proprietary to Builder Boost.

You may not copy, scrape, export, harvest, reproduce, distribute, train AI systems using, reverse engineer, or use Community Data to develop competing products, directories, databases, lead generation services, marketing services, or similar businesses.

Builder Boost reserves the right to pursue injunctive relief, monetary damages, attorney fees where permitted, and all other available legal remedies for violations of this section.

6. Intellectual Property

All Platform content, trademarks, branding, graphics, software, databases, directories, compilations, and Community Data are owned by Builder Boost or its licensors and protected by law.

7. Content You Submit

You retain ownership of content you submit but grant Builder Boost a non-exclusive, worldwide, royalty-free license to use, display, reproduce, publish, distribute, and store such content for Platform operations and promotion.

8. Media Release and Promotional Use

By participating in Builder Boost events, missions, webinars, content days, interviews, photo shoots, video productions, or related activities, you grant Builder Boost permission to use your name, likeness, image, voice, testimonials, photographs, and video recordings for promotional, educational, editorial, and marketing purposes unless otherwise agreed in writing.

9. Builder and Community Information

Information regarding builders, communities, incentives, inventory, commissions, promotions, events, and opportunities may be provided by third parties. Builder Boost does not guarantee its accuracy and users should independently verify information.

10. Confidential and Limited-Access Information

Users agree not to redistribute, disclose, publish, or share confidential, proprietary, restricted, or limited-access information obtained through the Platform.

11. Third-Party Services

Builder Boost is not responsible for third-party websites, software, tools, or services linked to or integrated with the Platform.

12. Marketing Communications

By registering, submitting forms, joining programs, downloading resources, or providing contact information, you consent to receive communications from Builder Boost. You may opt out of marketing communications at any time.

13. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” Builder Boost makes no guarantees regarding availability, accuracy, business outcomes, leads, referrals, sales, transactions, or revenue.

14. Limitation of Liability

To the fullest extent permitted by law, Builder Boost shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the Platform.

15. Indemnification

You agree to defend, indemnify, and hold harmless Builder Boost, its owners, employees, contractors, affiliates, and partners from claims arising from your use of the Platform, submitted content, or violations of these Terms.

16. Suspension and Termination

Builder Boost may suspend, restrict, or terminate access at any time for misuse of the Platform, misuse of Community Data, violations of these Terms, unlawful conduct, or conduct inconsistent with the integrity of the community.

17. Business Transfers

Builder Boost may merge, reorganize, obtain financing, sell assets, or undergo a change in ownership. User accounts, content, data, intellectual property, and contractual rights may transfer as part of such transactions.

18. Changes to These Terms

Builder Boost may revise these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.

19. Arbitration and Class Action Waiver

To the fullest extent permitted by law, disputes arising from these Terms or the Platform shall be resolved through binding arbitration rather than court proceedings, except where Builder Boost seeks injunctive relief to protect intellectual property, confidential information, Community Data, or proprietary rights.

Claims must be brought individually and not as part of any class action, collective action, or representative proceeding.

20. Governing Law and Venue

These Terms are governed by Texas law. Builder Boost operates in multiple jurisdictions, including Texas and Florida. Builder Boost may pursue remedies in any jurisdiction where unauthorized use, infringement, scraping, impersonation, or misuse of Community Data occurs.
